Terms of Service

1. Acceptance of Terms

By creating an account or using Vyrtex ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time, and continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old to use Vyrtex. By creating an account, you represent that you are 18 or older. We reserve the right to verify age and suspend accounts for underage users. Use of the Service is void where prohibited by law.

3. Account Terms

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate, current, and complete information during registration.
• You may not create multiple accounts, impersonate others, or use a fake identity.
• You may not share your account with another person.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions & Billing

Vyrtex Alignment Subscription — Vyrtex Alignment is a premium subscription plan priced at $9.99 per month (USD), billed via Chargebee, our third-party payment processor.

Automatic Renewal — Subscriptions automatically renew each month on the billing date. You will be charged the monthly rate unless you cancel before the renewal date.

Billing Dates — Your subscription is billed on the date of signup. For example, if you subscribe on the 15th of the month, you will be billed on the 15th of each subsequent month. Renewals occur on the same day each month.

Cancellation — You may cancel your Vyrtex Alignment subscription at any time through your account settings or by contacting support at support@vyrtex.app. Upon cancellation, your Vyrtex Alignment benefits continue until the end of the current billing period. There are no partial-month refunds.

Refunds — Vyrtex does not offer refunds for partial months. If you cancel mid-cycle, your subscription remains active until the end of the paid period. If you believe you were charged in error, please contact our support team.

Failed Payments — If a payment fails, we provide a grace period and will retry the charge. If payment cannot be collected after multiple attempts, your account may be downgraded to the Free plan, and Vyrtex Alignment features will be suspended until payment is resolved.

Chat Pass (Vyrtex Introduction) — The Chat Pass is a one-time, non-recurring feature priced at $1.99. It enables a priority introduction to a specific match before a mutual match exists. Chat Passes are non-refundable and do not auto-renew.

Chargebee — Payment processing is handled by Chargebee, a third-party payment processor. By subscribing to Vyrtex Alignment or purchasing a Chat Pass, you agree to Chargebee's processing of your payment information. See Chargebee's Privacy Policy for details.

Legal Entity — Vyrtex is operated by ClineeDesigns.

5. Prohibited Behavior

You agree not to engage in any of the following:

• Harassment & Abuse: Sending threatening, intimidating, or abusive messages. Stalking, doxxing, or any form of targeted harassment.
• Impersonation: Pretending to be someone else, including friends, celebrities, or Vyrtex staff.
• Illegal Activity: Using the Service for any illegal purpose, including solicitation, fraud, human trafficking, or distribution of illegal content.
• Explicit Content: Sharing sexually explicit content outside of private, consensual conversations. No unsolicited explicit images.
• Spam & Scams: Sending spam, promoting products or services, soliciting money, or running phishing or financial scams.
• Underage Content: Any content involving or referencing minors in a sexual context is strictly prohibited and will be reported to authorities.
• Hate Speech: Content that promotes violence, discrimination, or hatred based on race, ethnicity, religion, gender, sexual orientation, or disability.
• False Information: Knowingly providing false information in your profile or reports.

6. Community Guidelines

Vyrtex is built on respect. We expect all users to:

• Treat others with kindness and respect, even when you disagree on values.
• Communicate honestly about your intentions and who you are.
• Respect boundaries — if someone says no, stop.
• Report behavior that violates these guidelines using our in-app reporting system.
• Keep conversations within the platform until you're comfortable moving off-app.
• Always meet in public places and let someone know your plans.

7. Content Moderation Policy

Vyrtex reviews reported profiles, messages, and photos through user reports. Content that violates our policies may be removed without notice. Users who repeatedly violate policies may be permanently banned. We are working toward automated content screening and will update this policy as those features become available.

8. Reporting Process

Users can report concerns through our in-app reporting system, which covers 18+ categories including harassment, impersonation, threats, and safety concerns. The reporting process is:

1. Submit a report via the profile or chat menu — include evidence (screenshots, message excerpts, descriptions).
2. Our moderation team reviews the report as soon as possible.
3. We take appropriate action based on the severity and evidence, which may include warning, content removal, suspension, or permanent ban.
4. Reporters are notified when action is taken, but specific details of enforcement are not shared to protect user privacy and safety.
5. Users who believe a report decision was made in error may submit an appeal through their in-app report history.

9. Privacy Summary

Your privacy is important to us. Key points:

• We collect the information you provide (email, profile details, values screening answers) and usage data to improve matching.
• Your values answers are used exclusively for matching and are never shared publicly.
• Sexual compatibility preferences are entirely private until you explicitly share them with a match.
• We do not sell your personal data to third parties.
• Messages are stored securely and may be retained for safety purposes even after an account is deleted.
• You can request deletion of your account and associated data at any time through settings.

10. Age Verification

Vyrtex requires all users to confirm they are 18 or older at signup. We may request age verification documents if we have reason to believe a user is underage. Users found to be under 18 will have their accounts immediately suspended and may be reported to authorities.

11. Disclaimer of Liability

Vyrtex provides a platform for people to connect based on shared values. We are not responsible for the conduct of any user, whether online or offline. We do not conduct criminal background checks on users. We make no representations about the compatibility, safety, or intentions of any user. You assume all risk when using the Service and when meeting other users in person. We encourage you to take safety precautions, use the Trusted Date Plan feature, and meet in public places.

To the fullest extent permitted by law, Vyrtex disclaims all warranties, express or implied, including fitness for a particular purpose. Vyrtex shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

12. Termination Rights

We reserve the right to suspend or terminate accounts at our discretion, including for:

• Violation of these Terms or Community Guidelines.
• Behavior that we believe could harm other users, the platform, or third parties.
• Inactive accounts (no activity for 12+ months) may be deactivated.
• Requests from law enforcement or legal requirements.

You may terminate your account at any time through account settings. Upon termination, your profile and data will be removed or anonymized in accordance with our data retention policy. Certain data may be retained for legal or safety purposes as required by law.
